• You are responsible for all activity under your account.
• You agree to provide accurate information and keep it updated.

4. Acceptable Use

You agree not to misuse the service, including by:

• Violating laws, regulations, or third-party rights.
• Attempting unauthorized access or security testing without permission.
• Submitting malicious code, spam, or abusive content.
• Using the platform for prohibited surveillance or harmful activity.

5. Health and Medical Disclaimer

ModZen is not a medical provider and does not provide medical diagnosis, treatment, or emergency services. Information generated by ModZen is for informational purposes only and is not a substitute for professional advice.

6. HIPAA and Regulated Data

If you are a covered entity or business associate under HIPAA, you must not use ModZen for regulated PHI workflows unless a separate signed agreement (including a BAA where required) is in place.

7. Intellectual Property

You retain rights to content you provide, subject to rights needed for us to operate the service. ModZen retains rights in platform software, branding, and service materials.

8. Third-Party Integrations

Integrations (including Oura, Omi, social platforms, and model providers) are subject to third-party terms, availability, and API changes. We are not responsible for third-party outages or policy changes.

9. Disclaimer of Warranties

ModZen is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, ModZen will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business interruption.

11. Changes and Termination

We may update these terms or suspend/terminate access for violations, risk, or operational reasons. Continued use after updates constitutes acceptance of revised terms.

12. Governing Law and Venue

These Terms are governed by applicable law in the jurisdiction of service operation, unless otherwise required by mandatory consumer protection law in your place of residence. Venue for disputes will follow applicable law and any required local consumer rights.
